Antitrust enforcement in health care boomed under the last administration. The FTC challenged physician acquisitions, hospital mergers, and pharmaceutical deals. DOJ’s Antitrust Division indicted health care players for antitrust violations for the first time in 30 years and stepped back into the business of challenging provider mergers, which it had exited almost as long ago. Zealous state Attorneys General brought cases of equal—and sometimes greater—importance than their federal counterparts. And now there’s a new, Democratic administration and Congress in Washington, DC. Their message to health care antitrust aficionados might be: you ain’t seen nothing yet.
